Summary. An environmental permit is the document that makes an operation lawful, and obtaining one is a project management exercise as much as a legal one. Most programs are administered by delegated state agencies whose requirements exceed the federal floor, most applications are found administratively incomplete on first submission, and the timeline is driven by agency review cycles and public participation requirements rather than by the applicant's schedule. The decisions that determine how long it takes and what conditions result are made before the application is filed: whether the facility can be structured to stay below a major source threshold, what control technology the analysis will support, and whether the site presents a jurisdictional or community issue. This guide covers the preparation, the application itself, the review and public participation process, and the appeal and compliance obligations that follow issuance.
A permit application is not a form. It is a proposal to a regulator that describes what a facility will do, quantifies what it will emit or discharge, demonstrates that the applicable standards will be met, and — if it succeeds — becomes an enforceable order with which the facility must comply for years.
Applicants routinely underestimate two things: how long the process takes, and how much of the outcome is determined by decisions made before anything is filed.
Phase one: determine what is required
Identify every permit
A single project frequently needs several, from several agencies:
- Air: a preconstruction permit (PSD, nonattainment NSR, or a state minor source permit) and, for a major source, a Title V operating permit.
- Water: an NPDES permit for a point source discharge, a pretreatment permit for discharge to a municipal system, and a construction stormwater permit before ground is broken.
- Wetlands and waters: a § 404 permit from the Corps, plus § 401 water quality certification from the state, plus any state wetlands permit — which after Sackett v. EPA, 598 U.S. 651 (2023), is frequently the binding constraint where federal jurisdiction has narrowed.
- Waste: RCRA generator identification, and a permit for treatment, storage, or disposal.
- Underground injection, spill prevention, aboveground and underground storage tanks.
- Local: zoning, site plan, grading, and building permits, which have their own schedules and their own public processes.
- Other federal: Endangered Species Act consultation, National Historic Preservation Act § 106 review, and Coastal Zone Management Act consistency where applicable.
Where a federal permit, federal funding, or federal land is involved, NEPA attaches, and the environmental review becomes the schedule driver.
Determine who issues
Most federal programs are delegated to state agencies. The state's rules are the operative ones and frequently exceed the federal floor. Confirm the delegation status, because a program EPA has not delegated is administered by the region, with different timelines and different personnel.
Determine applicability, and structure around it
This is where the project is won or lost.
For air, compute potential to emit — the maximum capacity to emit, operating continuously, absent federally enforceable limits. A facility that will realistically emit forty tons per year may have a potential to emit of two hundred and fifty, which makes it a major source on paper.
Federally enforceable permit conditions limiting hours of operation, throughput, fuel type, or requiring control equipment can keep a source synthetic minor — below the threshold — and avoid PSD or nonattainment review and Title V entirely. That is frequently the single most valuable decision in the project, and it trades permitting burden for operational constraint for the life of the facility. Operations and counsel must make it together, because a limit that seems generous at design will be binding in year six.
For water, determine whether the discharge is to a water of the United States, to a municipal system, or to ground, because each is a different program.
Consider permits by rule and general permits. Many programs offer a general permit covering a category of activity, obtained by filing a notice of intent rather than an individual application. Construction stormwater, small sources, and many routine activities are covered. The trade is standard conditions the applicant cannot negotiate, in exchange for a process measured in weeks rather than months.
Phase two: prepare
The pre-application meeting
Request one. Most agencies offer them and most applicants skip them.
Bring: a project description, a preliminary emissions or discharge inventory, a site plan, and a list of the questions the applicant has not resolved. Ask: which permits does the agency believe are required, what does it consider a complete application, what modeling protocol will it accept, what is the realistic timeline, and are there site-specific or community issues the agency is aware of.
Confirm what was said in writing afterward. An agency's informal guidance is not binding, but a contemporaneous memorandum of the meeting is the record if the position later changes.
Assemble the technical work
This is the long pole and it should start first.
For air: an emissions inventory by unit and pollutant with documented emission factors; a BACT or LAER analysis using the top-down methodology — identify available technologies, eliminate technically infeasible options, rank by effectiveness, evaluate energy, environmental, and economic impacts, and select; dispersion modeling using an approved model on a protocol the agency has accepted in advance; and an ambient monitoring or preconstruction analysis where required.
For water: characterization of the discharge, application of the industry's effluent limitation guidelines, a water quality-based analysis against the receiving water's standards, an antidegradation review, and a mixing zone analysis where one is sought.
For wetlands: a delineation conforming to the Corps manual and, ideally, a jurisdictional determination — appealable under United States Army Corps of Engineers v. Hawkes Co., 578 U.S. 590 (2016); an alternatives analysis under the § 404(b)(1) guidelines demonstrating that the proposed discharge is the least environmentally damaging practicable alternative; and a compensatory mitigation plan, which for a mitigation bank credit purchase is simple and for permittee-responsible mitigation is a project in itself.
Across programs: the process description, the site plan, the equipment list, the control equipment specifications, and the compliance demonstration.
Retain qualified consultants, and retain them through counsel where the analysis may develop unfavorable information. Draft reports that the agency will eventually see should be prepared with that in mind.
Phase three: file
Completeness
Most applications are returned as administratively incomplete on first submission, and each round of completeness review adds weeks or months.
Build a completeness checklist from the agency's own regulation and application instructions, item by item, and confirm each before filing. Where an item does not apply, say so expressly rather than leaving it blank — a blank reads as an omission.
Note that administrative completeness and technical sufficiency are different. An application may be deemed complete and then generate rounds of technical information requests.
The completeness determination often starts a statutory clock. Where a state imposes a permit decision deadline, it typically runs from the completeness determination rather than from submission, which gives the agency an incentive to find applications incomplete. Understand the mechanics in the specific program.
Confidential business information
Applications become public records. Where the application contains genuine trade secrets — a process description, a formulation, a proprietary control approach — the applicable confidentiality procedure must be followed at the time of submission, generally by marking the material and submitting a substantiation. 40 C.F.R. Part 2, Subpart B, governs the federal procedure. Emissions data are not entitled to confidential treatment under the Clean Air Act, and applicants regularly try anyway.
Fees
Application fees, and for Title V, annual emissions-based fees that continue for the life of the permit and can be substantial.
Phase four: review and public participation
Technical review
The agency reviews, issues information requests, and prepares a draft permit with a statement of basis or fact sheet explaining the limits and their derivation.
Read the draft permit with extraordinary care. This is the last practical opportunity to correct a limit, a monitoring requirement, or a definition before it becomes an enforceable obligation for five years. Applicants focus on the numeric limits and overlook:
- Monitoring frequency and method, which drive operating cost.
- Averaging periods. A limit expressed as a one-hour average is far more constraining than the same number as a thirty-day rolling average, and the difference is negotiable.
- Recordkeeping and reporting obligations, and their deadlines.
- Compliance demonstration methods — whether a parametric approach is acceptable or stack testing is required, and how often.
- Definitions and applicability language, which determines whether a future change requires a permit modification.
- Startup, shutdown, and malfunction provisions.
Comment on the draft. The applicant is a commenter like any other, and issues not raised in comments may be waived on appeal.
Public participation
Public notice, a comment period, and — on request or where the agency determines there is significant interest — a public hearing.
The agency must prepare a response to comments addressing every significant comment, and that document becomes part of the record on any appeal.
Take this seriously. A permit drawing organized opposition takes longer, produces more conditions, and is more likely to be appealed. The applicant's most useful work happens before notice issues: identifying who is affected, meeting them, explaining the project in concrete terms, and offering enforceable commitments on the issues that matter locally — traffic, noise, odor, hours, and truck routes. Communities respond to permit conditions, not to promises.
State environmental review statutes — CEQA in California, SEQRA in New York, and analogues elsewhere — may impose a separate and more demanding process reaching purely private projects that need a discretionary approval, with its own document, its own comment period, and its own litigation exposure.
Environmental justice. Several states now require cumulative impact analysis for facilities in overburdened communities, and a few authorize denial on that basis. Where such a statute applies, siting is a threshold question rather than a mitigation question.
Phase five: issuance, appeal, and compliance
The final permit
Compare it line by line against the draft and against the comments. Where the agency changed a provision, confirm the change is what was intended.
Appeal deadlines are short — commonly thirty days — and appeals go to an administrative board, an environmental hearing office, or a court depending on the program. For EPA-issued permits, review is before the Environmental Appeals Board under 40 C.F.R. Part 124, and issues must have been raised during the comment period to be preserved.
An applicant may appeal an unacceptable condition; a third party may appeal issuance. A permit under appeal may or may not be effective in the interim, which determines whether construction can proceed and should be confirmed before mobilizing.
After issuance
Build the compliance calendar immediately. Every limit, every monitoring requirement with its frequency, every report with its due date, every certification, and the renewal application deadline — with an owner for each.
The renewal deadline is the one most often missed. Most programs provide that a timely and complete renewal application continues the existing permit in effect as an administrative extension; a late application does not, leaving the facility operating without a permit. Title V renewal applications are generally due six months to eighteen months before expiration depending on the program.
Modifications. Changes to the facility may require a permit modification, and the categories — administrative amendment, minor modification, significant modification — carry very different timelines. Determine which applies before making the change, because operating outside the permit is a strict liability violation whether or not the change would have been approved.
The permit shield. Title V's shield at 42 U.S.C. § 7661c(f) provides that compliance with the permit is deemed compliance with the applicable requirements identified in it. That is the practical value of Title V, and it is why the application should be exhaustive about what applies — a requirement omitted from the permit is not shielded.
Managing the schedule
Typical durations, which vary enormously by program, state, and controversy:
- General permit coverage by notice of intent: days to weeks.
- State minor source air permit: three to nine months.
- PSD or nonattainment NSR permit: nine to twenty-four months, longer if opposed.
- Title V initial permit: eighteen months or more; the statute contemplates eighteen and agencies frequently exceed it.
- Individual NPDES permit: six to eighteen months.
- Section 404 individual permit: twelve to twenty-four months, plus NEPA if it triggers.
- Nationwide permit verification: sixty to ninety days.
Sequence the work. Modeling and delineation take months and must start first. Local approvals frequently have to be obtained before or in parallel with state permits, and their public processes run on their own calendars.
Identify the critical path and manage it. On most projects it is either the air permit, the § 404 permit, or — where NEPA attaches — the federal environmental review.
Build in float. A single completeness round adds four to eight weeks. A public hearing adds two to three months. An appeal adds a year.
Do not order equipment against an assumed permit date, and do not commit to a customer delivery date that depends on one.
Practical counsel
Engage before the site is purchased. Attainment status, wetlands, receiving water quality, and community context are all fixed by the site, and permitting counsel brought in after the land is bought is solving a problem created two steps earlier.
Decide the synthetic minor question deliberately, with operations in the room.
Get the modeling protocol approved in advance. Modeling performed on a protocol the agency later rejects is repeated at the applicant's cost and on the applicant's schedule.
Read the draft permit as though you will be enforcing it against yourself, because someone will.
Comment on everything you would ever want to appeal.
Engage the community before notice, not after.
Assume every document you create will be produced. Applications, correspondence, consultant drafts, and internal analyses are all discoverable in a citizen suit or an enforcement action.
Coordinate with the transaction. Permit transferability varies — some transfer on notice, some require agency approval, some do not transfer at all — and confirming this early can determine deal structure.

- State delegated program regulations, which are the operative requirements in most cases.
A worked application: the coating line
A furniture manufacturer adds an automated finishing line at an existing plant in an ozone nonattainment area. The line uses solvent-based coatings and will emit volatile organic compounds.
Month one: applicability. The engineering estimate puts uncontrolled VOC emissions at 68 tons per year at full capacity. The nonattainment major source threshold in this area is 50 tons. Potential to emit, computed at maximum capacity operating 8,760 hours, is 112 tons — which triggers nonattainment NSR, LAER, and offsets at a ratio above one to one, which in this area are scarce and expensive.
The alternatives, evaluated together by counsel, engineering, and operations:
- Accept major source status, obtain offsets, apply LAER, and enter Title V. Cost: offsets alone run into six figures, plus a permit process of eighteen months or more.
- Install a regenerative thermal oxidizer with a 95 percent destruction efficiency and accept a federally enforceable requirement to operate it, reducing potential to emit below the threshold. Capital cost substantial, operating cost ongoing, but the facility stays minor.
- Accept a throughput limit — a federally enforceable cap on gallons of coating applied per rolling twelve months — that keeps potential to emit at 44 tons. Capital cost zero. Constrains production for the life of the permit.
- Reformulate to lower-VOC or waterborne coatings, reducing emissions at the source.
The company models production growth over ten years and concludes the throughput cap would bind by year four. It selects the oxidizer plus partial reformulation, accepting a synthetic minor limit with a comfortable margin.
Month one: the pre-application meeting. The agency confirms the synthetic minor approach, identifies the monitoring it will require for the oxidizer — continuous combustion chamber temperature with a minimum operating temperature established by the performance test — and agrees the modeling protocol.
Months two to five: technical work. Emissions inventory by coating and by unit, with vendor data sheets. Control efficiency demonstration. Modeling. A compliance demonstration method: coating usage records plus oxidizer temperature monitoring, rather than continuous emissions monitoring, which the agency accepts.
Month six: file. Completeness checklist run against the state regulation. One information request follows, on the destruction efficiency basis, answered in two weeks.
Month nine: draft permit. Two problems. The draft sets the VOC limit on a monthly basis rather than a twelve-month rolling total, which would constrain seasonal production peaks. And it requires annual stack testing where the pre-application discussion contemplated testing every five years with parametric monitoring in between. Both are raised in comments; both are resolved in the final permit.
Month eleven: issuance. No hearing was requested; the facility is in an industrial zone with no residential neighbors and the company met with the two adjacent businesses beforehand.
Then the compliance calendar: daily temperature records, monthly coating usage reconciliation, the twelve-month rolling calculation, semiannual reports, the annual certification, and the renewal application deadline.
Working with the agency
Permitting is a relationship conducted over months with a small number of people, and how it is managed affects both the timeline and the conditions.
Designate one point of contact on the applicant's side and keep it stable. Permit writers who receive inconsistent information from three people slow down and become skeptical.
Learn who the permit writer is and understand their constraints. They are usually carrying a dozen applications, working from a template, and accountable for defending the permit if it is appealed. An applicant who makes their job easier — organized submissions, prompt and complete responses, proposed language for difficult conditions — gets better outcomes than one who is merely persistent.
Propose language. Where a draft condition is unworkable, do not simply object; supply an alternative that achieves the agency's objective and works operationally. Permit writers adopt proposed language regularly because writing it themselves is the bottleneck.
Respond to information requests completely and on time. Partial responses generate follow-up requests, and each round costs weeks. Where an item cannot be provided, say why and offer a substitute.
Escalate rarely and carefully. Going over a permit writer's head to a supervisor or a commissioner is available and it is a card that can be played roughly once. Save it for a genuine impasse on a material issue, and do it politely.
Do not misrepresent anything. Applications are signed under a certification of truth, accuracy, and completeness, and a knowing false statement is a criminal violation under the Clean Air Act at 42 U.S.C. § 7413(c)(2) and the Clean Water Act at 33 U.S.C. § 1319(c)(4), as well as under 18 U.S.C. § 1001. An emissions estimate that turns out to be wrong is a technical dispute; one that was known to be wrong is a crime.
Document informal agreements. A permit writer's oral assurance about monitoring frequency does not bind the agency and will not survive that person's transfer to another position. Confirm in writing, and get material understandings into the permit itself.
Meet the deadlines the agency gives you. An applicant who takes three months to answer a two-week request has lost the standing to complain about the agency's pace.
And remember the relationship continues. The same office will review the renewal, the modification, and the next project, and will be the one deciding how to treat a deviation report. Applicants who are candid and organized are treated differently from those who are not, over years.
When the answer is no
Permits are denied, and applications are withdrawn under pressure. The options depend on why.
Denial for insufficiency. The most common outcome, and usually curable. The agency identifies what the application failed to demonstrate; the applicant supplements and refiles. Ask for the deficiencies in writing and for a meeting to confirm what a sufficient submission would contain.
Denial on the merits — the standards cannot be met at this site, with this design, at this scale. The alternatives are to redesign, to relocate, to reduce the project, or to appeal.
Appeal. Administrative first in most programs, then judicial review under the state APA or, for EPA permits, before the Environmental Appeals Board and then in the court of appeals. The standard is deferential: arbitrary and capricious, or unsupported by substantial evidence. Issues not raised during the comment period are generally waived, which is why comprehensive comments matter even when the applicant expects to prevail.
Constructive denial. Where an agency simply does not act, several states impose decision deadlines with a remedy — a deemed approval, a right to compel a decision, or a fee refund. Where a federal permit is involved, the 2023 NEPA amendments give a project sponsor a mechanism to seek a court order compelling agency action on a missed deadline. Mandamus-type relief is available in principle and rarely granted.
Conditions the applicant cannot live with. An issued permit with an unacceptable condition is appealable, and the applicant may also seek a modification. Weigh carefully: appealing a condition puts the whole permit at issue in some programs, and the agency may revisit provisions the applicant liked.
Third-party appeals. A permit issued over opposition may be appealed by neighbors or by an environmental organization with standing. The permit's effectiveness during the appeal varies by program and is the first thing to determine, because it decides whether construction proceeds. Consider whether to seek intervention rather than relying on the agency to defend its own permit — agencies settle, and the applicant's interests are not identical to theirs.
The commercial decision. Some projects should be abandoned. A site in a severe nonattainment area with unavailable offsets, a wetland fill with no practicable alternative demonstration, or a facility in a community with an environmental justice statute and organized opposition may be unpermittable at acceptable cost. Saying so early, before the capital is committed, is the most valuable advice permitting counsel gives.
Existing facilities: modifications and renewals
Most permitting work is not a new facility. It is a change to one that already operates, and the analysis is different.
The threshold question for air is whether the change is a modification triggering New Source Review. A physical change or change in the method of operation resulting in a significant net emissions increase triggers review. Two exclusions matter enormously:
- Routine maintenance, repair, and replacement, whose boundary generated the decade-long NSR enforcement initiative against the power sector. The analysis considers the nature, extent, purpose, frequency, and cost of the work relative to the unit.
- Debottlenecking and increased utilization, where an increase in hours or rate at an existing unit may not be a modification at all if it could have been accommodated before.
Environmental Defense v. Duke Energy Corp., 549 U.S. 561 (2007), confirmed that "modification" may be defined differently under PSD than under the NSPS program. Netting — offsetting the increase with contemporaneous decreases elsewhere at the facility — can keep a project below the significance threshold, and it requires the decreases to be federally enforceable and contemporaneous.
Document the applicability analysis contemporaneously. An enforcement action years later will ask what the company concluded and when. A memorandum prepared before the change, with the emissions calculations, is the defense. Its absence is the case.
Title V modifications come in tiers — administrative amendment, minor permit modification, and significant modification — with very different timelines, from thirty days to a full review with public notice. Determine the tier before the change, because the schedule may drive the project.
Off-permit changes are permitted in some programs where the change is not subject to any applicable requirement and the source provides contemporaneous written notice. The conditions are narrow.
Water permit modifications where the discharge changes in character, volume, or location, and where a new outfall is added.
Renewals are the most common failure. Title V renewal applications are due six to eighteen months before expiration depending on the program; NPDES renewals generally 180 days before. A timely and complete application continues the permit as an administrative extension; a late one does not. Diary the renewal deadline the day the permit issues, and treat the renewal as an opportunity — it is the one occasion to seek relief from a condition that has proved unworkable, using operating data the facility now has.
Change of ownership. Confirm transferability before the transaction closes. Some permits transfer on notice, some require agency approval and a new application, and a few do not transfer at all.
Assembling the team
Environmental permitting is one of the few legal projects where the lawyer is not the principal author of the deliverable, and the team composition determines the outcome.
The environmental consultant prepares the emissions inventory, the modeling, the delineation, and most of the technical narrative. Select for experience with the specific program and the specific agency, not for general capability — a firm that has modeled twenty projects reviewed by this office knows what the reviewer will ask. Ask for references from applicants, and ask what percentage of their applications were found complete on first submission.
The engineer of record for the process and the control equipment, whose design assumptions become permit conditions. The engineer must understand that a capacity figure stated for design purposes becomes a federally enforceable limit.
Counsel owns applicability, the structuring decision, the comment strategy, the appeal posture, and the relationship between the permit and the company's contractual and transactional obligations. Counsel should also own the question nobody else asks: what happens if the permit takes twice as long as projected.
Operations must be in the room for every decision that becomes an operating constraint. A limit accepted by a project team and discovered by a plant manager in year three is a compliance problem waiting to happen.
A community relations lead where the project will draw attention, engaged before public notice.
Retain the consultant through counsel where the analysis may develop unfavorable information — a modeling result that shows an exceedance, a delineation that finds more wetland than expected, a sampling result. Privilege over that work is not guaranteed and it is substantially stronger where counsel directed it for the purpose of legal advice.
Budget realistically. Consultant fees for a PSD application with modeling run well into six figures; a § 404 individual permit with mitigation likewise. Counsel's fees are usually a fraction of the technical cost, and the technical cost is a fraction of the project's cost of delay.
Set the internal reporting cadence — a monthly written status covering the schedule, the critical path, the open information requests, and the risks — and send it to whoever controls the capital plan. Permitting delays surprise executives who were not being told, and the surprise damages the project more than the delay does.
