Tool 1 — Pre-purchase inspection request

I am interested in the [year make model], stock [ ], VIN [ ]. Before I make an offer, I would like to have the vehicle inspected by [mechanic/shop], at my expense, at their facility. Please confirm that you will make the vehicle available for that inspection on [date/time], and let me know what arrangements you need.

I would also like copies of: the Buyers Guide for this vehicle; the vehicle history report you rely on; any auction announcement sheet; any reconditioning or repair records; and the prior title.

A dealer that refuses an independent inspection has answered your question. This request costs a small amount and is the highest-return money in the transaction.

Tool 2 — Representation confirmation (get it in writing)

To confirm our conversation of today: you have represented that this vehicle (a) has not been in an accident and has no prior structural or frame damage; (b) has a clean title and has never been branded salvage, flood, rebuilt, or lemon-law buyback; (c) has actual mileage of [ ]; (d) has had [N] prior owners; and (e) [any other specific representation].

I am relying on these representations in deciding to purchase. Please sign below to confirm, or correct anything that is inaccurate.

"As is" never protects a lie. This one page converts sales talk into an express warranty and a fraud exhibit.

Tool 3 — Repair order correction language (say this at the desk)

"Before I sign, I need the complaint to read as I described it. Please write: 'Customer states [exact symptom], occurring [frequency], at [speed/condition], most recently on [date].' Please also record the current mileage and note that I asked whether a technical service bulletin or customer satisfaction program covers this condition."

And when you pick it up: "May I have a copy of the completed repair order showing the complaint, cause, correction, parts used, date in, date out, and mileage?"

The warranty claim history exists independently of the dealer, which matters when a dealer will not produce its own repair orders.

Tool 6 — Manufacturer lemon law notice

I purchased this vehicle new on [date] from [dealer], [city, state]. Current mileage: [ ].

The nonconformity. Since [date] the vehicle has exhibited: [precise description]. This substantially impairs the [use / value / safety] of the vehicle because [one sentence].

Tool 7 — Revocation of acceptance letter (to the dealer)

I hereby revoke my acceptance of the above vehicle. Its nonconformity substantially impairs its value to me.

I accepted the vehicle [without discovering the nonconformity, which was not reasonably discoverable at the time of acceptance / in reasonable reliance on your assurance that it would be cured, and it has not been cured].

Demand. Return of the purchase price of $[ ], including the down payment of $[ ], the trade-in allowance of $[ ], taxes and fees of $[ ], and all installment payments made totaling $[ ]; plus incidental and consequential damages of $[ ].

This letter also constitutes notice of breach of the express warranty [describe] and of the implied warranty of merchantability, which was not effectively disclaimed because [a written warranty was given / a service contract was sold within ninety days of sale].

Tool 8 — Holder Rule notice to the lender

To: [Lender], [address] Re: Account [ ] — Assertion of claims and defenses against the holder

The retail installment contract dated [ ], which you hold, contains the notice required by the Federal Trade Commission's Preservation of Consumers' Claims and Defenses rule, stating that any holder of this consumer credit contract is subject to all claims and defenses which the debtor could assert against the seller.

I am asserting against you, as holder, the claims and defenses I hold against [dealer], namely: [fraud in the inducement / breach of express warranty / breach of the implied warranty of merchantability / violation of the Used Car Rule / violation of the state deceptive practices act], arising from [one paragraph].

Tool 9 — Add-on cancellation demands

Service contract

I am cancelling the vehicle service contract, contract number [ ], purchased [date] for $[ ], effective immediately. Please issue the refund due under the cancellation provision and apply it to the principal balance of my loan with [lender], account [ ]. Please send me written confirmation of the refund amount, the date issued, and the recipient. Copies to the dealer and to [administrator].

Gap insurance

I am cancelling the gap waiver/insurance purchased [date] for $[ ]. [If applicable: the loan has been paid in full as of [date], and a refund of the unearned premium is due.] Please issue the refund and apply it to the loan principal, or remit it to me if the loan is paid, and confirm in writing.

Ancillary products

I am cancelling the following products purchased on [date] and requesting a full or prorated refund as provided: [paint/fabric protection $; window etching $; key replacement $; tire and wheel $]. Please confirm the refund amounts and their application to my loan principal.

Tool 10 — Yo-yo financing and trade-in restoration demand

To: [Dealer] Re: Purchase of [vehicle], contract dated [ ] — demand for performance or rescission

On [date] I signed a [purchase agreement / retail installment contract] and took delivery. On [date] you informed me that financing was "not approved" and asked me to sign a new contract at a higher [rate / payment / term].

My position. [Option A: The contract is unconditional on its face and you are bound by its terms. I demand that you perform.] [Option B: If the contract was conditional, the condition was [quote], and you did not comply with it because [ ].]

In either case I demand:

  1. Immediate return of my trade-in, [year make model], VIN [ ] — or, if it has been sold, payment of its actual cash value of $[ ], supported by [valuation];
  2. Immediate return of my down payment of $[ ];
  3. Return of all documents bearing my signature and confirmation that no credit applications will be submitted without my written authorization.

I will not sign a new contract. Any repossession or demand for return of the vehicle should be accompanied by a written statement of the legal authority claimed.

Tool 11 — Odometer fraud demand

To: [Seller/Dealer] Re: [Year make model], VIN [ ] — Odometer disclosure violation

The federal odometer disclosure statement you executed on [date] represented mileage of [ ]. The actual mileage was at least [ ], as established by: [prior title record dated __ showing __ miles; state inspection record dated __; service records dated __; auction announcement].

Federal law provides a private civil action for a violation committed with intent to defraud, with damages of three times actual damages or a statutory minimum, whichever is greater, plus costs and reasonable attorney's fees.

Demand: rescission and return of $[ ], or in the alternative damages of $[ ] representing the diminished value, together with costs and fees. Please respond within fourteen days.

Tool 12 — Settlement demand letter skeleton

Confirm whether the decision binds the manufacturer but not you. In most programs it does, which makes participation nearly costless.

The two questions that win these: "What did the Buyers Guide say?" and "Where is the repair order recording my complaint?"

Tool 15 — Deficiency defense outline (after repossession)

1. Breach of the peace. The repossession involved [breaking a lock / entering a closed garage / proceeding over my objection at the scene / a confrontation], which is a breach of the peace precluding self-help and giving rise to liability. 2. Defective notice. The notice of intended disposition [was not sent / omitted required content / did not provide the required advance time]. 3. Commercial unreasonableness. The vehicle, worth approximately $[ ] at retail, was sold for $[ ] at wholesale auction without [advertising / retail marketing / reconditioning]. 4. Setoff and recoupment.
