Summary. Seventeen documents. The annual review takes two hours and prevents most of the rest.
The one rule
A CDL holder may not use diversion, deferred adjudication, or driving school to keep a conviction off the record. Masking is prohibited by federal law, including for violations in a personal vehicle.
Which means the single most important item here is Template 5 — the script for screening a lawyer before you resolve a ticket. A general traffic lawyer will offer you the plea that ends your career, and will do it in good faith.
Template 1 — Annual records review
Two hours a year. Do it on the same date each year.

The three failures this prevents:
- Letting it lapse — in most states the CDL is downgraded by operation of law, which makes continued driving a serious traffic violation or worse
- Assuming the state received it — transmission fails regularly. Call and confirm.
- Not knowing your interval — certain conditions require certification more often than two years
Template 5 — Lawyer screening script
Use this before resolving any citation. It takes three minutes and it is the most valuable item in this toolkit.
"I hold a Class [A/B/C] CDL. I've been cited for [violation] in [state/county] on [date].
Do you handle CDL cases specifically?
I understand that masking is prohibited — deferred adjudication, diversion, and driving school are not options for me, because the conviction appears on my record either way.
So my questions are:
- What would this violation count as under the federal disqualification rules — a serious traffic violation, a major offense, or neither?
- I have [N] prior serious violations in the last three years. What does this one do to me?
- What outcomes are available that don't involve masking? Dismissal, acquittal, amendment to a non-moving violation, or a plea to a lesser moving violation that isn't a serious traffic violation?
- What's your experience with this court on CDL matters?
- What will this cost?"
If the lawyer offers deferred adjudication or driving school, they do not handle CDL cases. Call someone else.
Also do:
- Pull your driving record before the court date
- Count your priors in the last three years
- Ask your carrier's safety department what the violation does to your employment
- Notify your employer of any conviction within the required period (generally 30 days) and notify the licensing state

At every inspection:
- Do a real pre-trip and document it — most roadside violations are things a pre-trip catches
- Have ready: license · medical certificate · registration · insurance · permits · logs · bills of lading
- Be professional — the report is permanent
- READ the report before signing — signing acknowledges receipt, not agreement
- Get a copy
- Note anything incorrect at the time
- Never move a vehicle under an out-of-service order
Template 8 — Detention and stop log
The record that supports a wage claim, defends an hours question, and proves a coercion complaint — all at once.

Why it does triple duty:
- Wage claim — minimum wage obligations apply to total hours worked in a week regardless of the mileage formula
- Detention pay — most contracts that provide it require documentation drivers never keep
- Hours defense — you can show exactly where the fourteen hours went
- Coercion evidence — it shows the situation the dispatcher was pressuring you into
The ELD captures duty status. It does not capture why. Your note does.
Template 9 — The refusal message
The single piece of evidence that wins whistleblower and coercion cases.
Send at the time, through whatever channel dispatch uses:
"I'm at hour [13:20] of my 14-hour window / I have [N] minutes of drive time remaining / I've been on duty since [time]. Running this load would put me in violation of the hours-of-service rules. I can't take it. Please reassign, or let me take my required rest and run it after."
For a vehicle condition:
"The [brakes / tires / lights / steering] on unit [___] are [specific condition]. I reported this on [date] to [name]. I'm not able to operate it in this condition — I believe it presents a serious safety hazard."
If they push back, respond ONCE more in writing:
"I understand the customer is waiting. I've told you this would be a violation and I'm not able to run it."
Then:
- Screenshot the exchange
- Forward it to your personal email
- Log everything that follows — miles cut, loads reassigned, dispatch changed, discipline, termination — with dates
Template 10 — Whistleblower complaint
To OSHA. Deadline: generally 180 days from the adverse action.

Keep every document. Carriers that hire drivers who have completed return-to-duty exist, and the driver who can produce a complete clean file gets a different conversation.
Template 13 — Settlement statement audit
For owner-operators and lease drivers. Reconcile every statement.

- Charges that appear without explanation
- Escrow balance — is it disclosed, and is it accumulating as agreed?
- Maintenance charges — were they authorized, and is there an invoice?
- Insurance charges against the actual policy cost
- Fuel surcharge treatment
- Detention pay owed under the contract but not paid
- Accessorial pay — layover, stop-off, tarping, lumper
- Whether a fixed payment applied in a week with few miles — a negative week is the pressure that produces hours violations
Request in writing: "Please provide written authorization for the deduction of $______ on the settlement dated [date], and an invoice for the maintenance charge of $______."
Template 14 — Lease-purchase review

Have a lawyer read it before signing. These arrangements have been the subject of substantial enforcement and litigation.
Template 15 — Post-crash checklist
AT THE SCENE
- Safety first; then law enforcement and the carrier
- Say NOTHING about fault — not to the other driver, a witness, or an adjuster
- Photograph: both vehicles, all four sides · the roadway · skid marks · debris field · signage · lighting · weather · the whole scene from several angles
- Witness names and phone numbers — the police report frequently lacks them
- Note the time, conditions, and what you were doing in the preceding minutes
- Get the police report number and the officer's name
TESTING
- Post-accident testing is required after certain crashes. The time limits are strict.
- Do NOT leave and become unavailable — that can be treated as a refusal
PRESERVE IMMEDIATELY (all overwritten on cycles measured in days)

The short version
- Never plead to a citation without CDL-specific advice. Masking is prohibited; the offer is a trap.
- Calendar the medical certificate, and confirm the state got it.
- Do the two-hour annual review.

- Refuse illegal loads in writing. The message is the case.
- 90 days for coercion. 180 for whistleblower.
- Log detention at every stop. Wage claim, hours defense, and coercion evidence at once.
- Read the lease-purchase before signing, especially what happens to the escrow.
