Tool 3 — Background check denial challenge

Seller certifies that Seller is the lawful owner, that the firearm is free of liens, that Seller has no knowledge or reasonable cause to believe Buyer is prohibited, and that Seller has verified Buyer's identification and state of residence.

Both parties acknowledge that [state] law [does / does not] require this transfer to be processed through a licensed dealer, and that if it does, this document does not substitute for that requirement.

The better course in nearly every case is to route the transfer through a licensed dealer for the background check and the record.

Tool 8 — Inventory template

Store off-site. Update annually. This document is what you will need for a police report, an insurance claim, a restoration petition, and an estate.

Tool 9 — Theft or loss report checklist

• Report to local law enforcement immediately; note any state deadline.
• Provide make, model, caliber, and serial number for each item.
• Obtain the report number and a copy of the report.
• Notify the insurer.
• If a licensee, file the required theft/loss report within the deadline.
• Note the date, time, and circumstances of discovery.
• Review and improve storage; document what changed.

Tool 10 — Surrender compliance and return request

Tool 11 — Order termination request outline

Tool 12 — Restoration petition outline

1. Identify the exact disability. [State felony conviction / federal conviction / domestic violence misdemeanor / mental health adjudication or commitment / protective order / erroneous record.] The route depends entirely on this. 2. The record. Certified dispositions for every case; charging documents; sentence and completion; any prior relief. 3. The statutory route. [State expungement / set-aside / pardon / restoration of civil rights — and whether the relief is complete or expressly withholds firearms rights; state relief-from-disabilities program for a mental health prohibitor; administrative record correction.] 4. Eligibility. Waiting period satisfied; all fines, restitution, and supervision completed; no disqualifying subsequent conduct. 5. Rehabilitation. Employment; education; treatment; community involvement; time elapsed; letters from people who know the petitioner now. 6. Public safety. Why restoration presents no risk, addressed directly. 7. Relief requested, stated precisely, including a request that the order state expressly that firearms rights are restored. 8. Notice to the prosecuting authority and any other party the statute requires.

Tool 13 — Plea colloquy advisory (for criminal practitioners)

On the record, before any plea:

"Mr./Ms. [defendant], I want to be sure you understand a consequence of this plea beyond the sentence. A conviction for this offense [is punishable by more than one year / is a misdemeanor crime of domestic violence], which means that under federal law you will be prohibited from possessing any firearm or ammunition, [for life / unless and until your rights are restored]. That prohibition applies everywhere in the United States, regardless of state law, and violating it is a separate federal felony. If there are firearms in your home, you will need to address that. Do you understand?"

Counsel's file checklist before advising a plea:

• Statute and subsection of the offered plea, and its maximum penalty
• Whether the elements and relationship make it a misdemeanor crime of domestic violence
• Whether any state prohibitor attaches
• Whether alternatives exist: a plea to a non-qualifying offense · deferred disposition · diversion
• Whether the client possesses firearms, and the plan for lawful disposition
• Whether restoration will be available, by what route, and after how long
• Advisory given and documented

Tool 14 — Dealer compliance audit

Correction protocol: correct only as the regulations permit · never backdate or obscure an original entry · document what was corrected, by whom, and when · assess whether any transfer went to an ineligible person and report if required.

Tool 15 — Straw purchase refusal memorandum

Refusing a sale is always permitted, and a documented refusal protects the licensee.

Tool 16 — Estate firearms memorandum
